Abstract

India's Scheduled Tribes (STs) constitute diverse indigenous and tribal communities with distinctive languages, cultures, customary practices, livelihoods and relationships with land and forests. The Indian constitutional framework recognizes the need for special protection and affirmative measures for these communities. Articles 15(4), 16(4), 21A and 46, together with the Fifth and Sixth Schedules, establish important constitutional foundations for tribal welfare and educational advancement. These provisions are supplemented by legislation such as the Panchayats (Extension to Scheduled Areas) Act, 1996 (PESA), the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (FRA), the Right of Children to Free and Compulsory Education Act, 2009, and the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. The Ministry of Tribal Affairs identifies these constitutional and statutory measures as central components of the legal framework governing tribal development and protection. This paper critically examines the relationship between legal safeguards and the lived realities of tribal communities, with particular emphasis on education. It analyses how constitutional provisions, protective legislation, local self-governance, forest and land rights, affirmative action and educational entitlements collectively contribute to tribal development. The paper argues that although India possesses an extensive legal architecture for tribal protection, the effectiveness of these provisions depends upon meaningful implementation, community participation, culturally responsive education, protection of customary rights, institutional accountability and awareness of legal entitlements.
