Acknowledgement

These Terms govern the use of the Website’s interactive services, including manuscript submission, account facilities where available, and publication-related payments. They set out the responsibilities of users and the Company.

By using these services, You agree to the applicable Terms. If You disagree with them, You should not use the affected services.

Published scholarly articles remain freely available to read and download without registration or a minimum-age requirement. Any legal-capacity requirements for entering a publication or payment agreement apply separately to that transaction.

Article reuse is governed by the licence stated on each article. These Terms do not impose additional restrictions on permissions granted under that licence.

Our Privacy Policy explains how personal information is collected, used, and disclosed. Please review it before providing personal information through the Website.

Links to Other Websites

The Service may contain links to third-party websites or services that the Company does not own or control.

The Company is not responsible for their content, privacy policies, or practices. To the extent permitted by applicable law, the Company is also not liable for damage or loss arising from their use or reliance on their content, goods, or services.

Please read the terms and privacy policies of any third-party websites You visit.

Termination

We may suspend or terminate access to interactive services if You breach these Terms, misuse the services, or create a security risk. Where practicable, You will be informed of the reason.

Upon termination, Your right to use the affected services will cease.

Suspension or termination does not impose additional restrictions on lawful access to published articles. Any termination or reinstatement of reuse rights is governed by the applicable article licence.

Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of the Company and its suppliers under these Terms is limited to the amount actually paid by You through the Service.

To the same extent, the Company and its suppliers are not liable for special, incidental, indirect, or consequential damages arising from the use of, or inability to use, the Service.

Such damages may include loss of profits, data, or other information; business interruption; personal injury; loss of privacy; or losses connected with third-party software or hardware used with the Service.

These limitations apply even if the Company or a supplier has been advised of the possibility of such damages, or a remedy fails to achieve its essential purpose.

Some jurisdictions do not permit certain exclusions or limitations. In such cases, each party’s liability is limited only to the extent permitted by applicable law.

“As Is” and “As Available” Disclaimer

The Service is provided on an “as is” and “as available” basis, with all faults and defects.

To the maximum extent permitted by applicable law, the Company, its Affiliates, licensors, and service providers disclaim all express, implied, and statutory warranties concerning the Service.

These include warranties of merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from a course of dealing, performance, or trade practice.

The Company does not guarantee that the Service will meet Your requirements, achieve an intended result, or be compatible with other software, applications, systems, or services.

The Company also does not guarantee uninterrupted or error-free operation, particular performance or reliability standards, or the correction of every error or defect.

Neither the Company nor its providers guarantee the accuracy, reliability, or currency of information made available through the Service.

They also do not guarantee that the Service, its servers, content, or emails are free from viruses, malware, or other harmful components.

Where applicable law does not permit a particular warranty exclusion or limitation of statutory consumer rights, that exclusion or limitation applies only to the extent legally permitted.

Governing Law

These Terms and Your use of the Service are governed by the laws of India, excluding its conflict-of-law rules.

Applicable mandatory laws and rights remain unaffected.

Dispute Resolution

If You have a concern or dispute relating to the Service, You agree to first attempt an informal resolution by contacting the Company.

For European Union (EU) Users

If You are a consumer residing in the European Union, You retain the protection of any mandatory legal provisions applicable in Your country of residence.

Legal Compliance

You must comply with applicable legal requirements when using manuscript submission, payment, account, and other interactive services.

Payment processing may also be subject to the lawful requirements of the relevant payment provider. These requirements do not introduce additional restrictions on access to or reuse of published articles under their open licences.

Severability and Waiver

Severability

If any provision of these Terms is found invalid or unenforceable, it will be interpreted or adjusted to achieve its purpose as far as applicable law permits.

The remaining provisions will continue in full force and effect.

Waiver

A party’s failure to exercise a right or require performance of an obligation does not prevent that party from doing so later.

Waiving one breach does not constitute a waiver of any subsequent breach.

Translation Interpretation

If these Terms are made available in another language, the original English text will prevail in the event of a dispute.

Changes to These Terms and Conditions

We reserve the right to modify or replace these Terms at Our discretion.

For material changes, We will make reasonable efforts to provide at least 30 days’ notice before the revised Terms take effect. The Company will determine whether a change is material.

Continued use of the affected interactive services after revised Terms take effect constitutes acceptance of those Terms. If You do not agree, You should stop using those services.

Changes to these Terms do not revoke or restrict permissions already granted under a published article’s open licence.
